3. Website Provision and Server Log Files
When visiting the website, technically necessary data is processed automatically (IP address, date/time, browser, operating system, pages accessed). This data serves the purposes of security, stability, and error detection. Server log files are generally deleted after 7 days, unless statutory retention obligations or security incidents require a longer storage period.

6. Order Processing and Customer Management
For the execution of services, all necessary master data, contract data, identity data, and KYC data are processed. Data is accessed internally only by authorized employees. External service providers receive only the data necessary for their specific partial service.
7. International Data Transfers
Due to the business model (incorporations in Switzerland, the USA, and the UAE), the transfer of personal data abroad is an integral part of the service.
- United States of America
Data may be transferred to recipients in the USA (e.g., for US incorporations or through cloud services). Where the recipient is covered by the Swiss-U.S. Data Privacy Framework, an adequate level of data protection is deemed to exist. Otherwise, appropriate safeguards (e.g., standard contractual clauses) shall be agreed. - United Arab Emirates (UAE)
For incorporations in the UAE, data must mandatorily be transferred to local authorities, free zones, and partners (registered agents). As no adequacy decision by Switzerland exists for the UAE, the transfer is based on: - The necessity for contractual performance (Art. 16 FADP);
- Overriding legitimate interests;
- Where applicable, standard contractual clauses concluded with the partners.
The Customer acknowledges that without these transfers, the desired service (incorporation) cannot be provided:

SetCorp assesses the lawfulness of data transfers on a risk-based basis and employs technical and contractual protective measures where possible.
8. Disclosure to Third Parties and Partners
Data is only disclosed where necessary for the performance of the order. Categories of recipients are:
- Incorporation partners: Local agencies, trustees, registered agents.
- Authorities: Commercial registers, immigration authorities, licensing bodies, free zones.
- Service providers: Notaries, lawyers, translators, courier services, payment providers.
To the extent that third parties act independently (e.g., authorities, notaries), their own data protection provisions shall apply in a supplementary manner.
9. KYC, Compliance, and AML Checks
Identity verification is carried out for the prevention of money laundering and compliance with international sanctions. This includes the processing of copies of identification documents and information on beneficial ownership. The legal basis is the fulfillment of statutory obligations (where applicable) or the legitimate interest in secure business processing.
10. Payment Processing
Payments are processed through external service providers. SetCorp receives only the data necessary for allocation and confirmation (amount, status, transaction ID). The data protection provisions of the respective payment provider shall apply.
11. Storage Duration and Deletion
Data shall be deleted as soon as the purpose for its processing no longer exists and no statutory retention obligations (e.g., under tax or commercial law, typically 10 years for business records) remain. KYC data shall be retained in accordance with applicable anti-money laundering regulations.
12. Data Security
SetCorp implements appropriate technical and organizational measures (encryption, access controls, authorization concepts, backups) to protect data against unauthorized access and loss. However, absolute security cannot be guaranteed.
13. Data Breaches
In the event of a data breach, statutory notification obligations to authorities and affected individuals shall be complied with.
14. Automated Decision-Making
SetCorp does not make decisions that are based solely on automated processing and that produce legal effects (no profiling with legal consequences).
15. Rights of Data Subjects
Under the applicable data protection law, you have the following rights:
- Access to your stored data;
- Rectification of inaccurate data;
- Erasure (to the extent no retention obligation exists);
- Restriction of processing;
- Data portability;
- Withdrawal of a given consent;

17. Right to File a Complaint with a Supervisory Authority

Where a Customer provides data of third parties (e.g., shareholders), the Customer is responsible for having obtained the necessary consents or for ensuring that a legal basis for the disclosure exists.
19. International Incorporation Services
The Customer acknowledges that services such as the incorporation of a US LLC, a UAE company, or a Swiss AG cannot be carried out without the transfer of data to the respective country registers and authorities. Refusal of such transfer renders the service impossible.
20. Special Data Categories
The processing of particularly sensitive data (e.g., political opinions, health data) shall only take place where strictly necessary for the performance of the order (e.g., medical checks for visas) and is based on a legal ground or consent.
